Terms and Conditions of Sale
NOREXCO® distributes its products exclusively to professionals. These terms apply from 01/01/2025 and replace any previous version.
Delivery and transport
Mainland France
Any order of 500.00 € excl. VAT or more, delivered to a single address in mainland France, qualifies for free shipping. Shipments of abrasives and equipment returns are excluded from this provision and are always invoiced for transport costs. A handling fee of 7.50 € excl. VAT applies to any order under 75.00 € excl. VAT, excluding shipping costs.
Approved carriers from Ville-la-Grand: orders ≥ 30 kg by Messageries Annemassiennes or Dachser; orders < 30 kg by TNT, FEDEX, GLS, COLISSIMO or LA POSTE.
No other carrier will be accepted without prior written agreement, in which case all costs will be borne entirely by the customer. Express delivery: all costs are borne by the customer.
Abroad and French overseas territories
Ex-works; transport at the customer's expense.
Specific delivery conditions
Delivery exclusively to the customer's usual address. Any delivery to an address other than the one usually on record is exceptional and will be carried out under the terms defined by NOREXCO®, which reserves the right to select the carrier. Additional charges may be invoiced depending on the specific transport conditions.
NOREXCO® cannot be held liable for any additional costs, in particular storage or redelivery in the event of absence, which will be re-invoiced to the customer. A surcharge may be applied for any special delivery to a worksite or hard-to-reach area where applicable. In the event of direct delivery to an end customer, a flat fee of 5.00 € excl. VAT (<30 kg) or 10.00 € excl. VAT (≥30 kg) will be invoiced.
Liability for damage
Goods travel at the buyer's risk, whatever the delivery terms. The recipient alone is responsible for lodging precise, detailed reservations with the carrier in the event of damage, under Articles 105 et seq. of the French Commercial Code, within 48 hours. In the event of a dispute, the delivery note signed with precise reservations is essential for any claim.
Product availability
NOREXCO® strives to deliver an order in full as soon as possible. In the event of partial unavailability, the remainder will be shipped later, with shipping costs invoiced if the initial order did not qualify for free shipping. If the customer does not wish to receive a partial delivery, this must be stated when ordering.
Claims and returns
No return will be accepted without written authorisation from NOREXCO®. Return costs are borne by the customer, unless previously agreed in writing by NOREXCO®.
Warranty
Scope of the warranty
NOREXCO® warrants its equipment against any manufacturing or material defect, in the context of compliant use, for 12 months from the date of purchase.
Conditions of validity: use in accordance with the manufacturer's instructions and original NOREXCO® identification — plates, serial number, stickers — intact.
Warranty exclusions
Misuse, negligence, accident, application of abrasive, corrosive or chemical products, non-compliant installation or modification of the operating process, normal wear and tear.
Handling procedure
The defective equipment must be returned at the customer's expense, carriage paid. No replacement before receipt and analysis of the equipment. In an emergency, a new part may be shipped at the customer's expense, with reimbursement after the defect is confirmed.
If no manufacturing defect is found, repair and transport costs will remain at the customer's expense. The warranty excludes any compensation for operating losses or other indirect damage.
Out-of-warranty repairs and overhauls
A quote is drawn up before any work. No work will be carried out without the customer's written agreement. Return shipping will be carriage forward, at the customer's expense.
Without a reply within 60 days of the quote being sent, the equipment will be returned carriage forward or destroyed without further notice.
Delivery times
NOREXCO® does its utmost to meet the announced deadlines, but these remain indicative. No delay may give rise to penalties, refusal of goods or cancellation of an order.
Ownership of goods
Goods remain the property of NOREXCO® until payment in full, in accordance with the French law of 12 May 1980. In the event of a dispute, only the Court of Thonon-les-Bains (74) shall have jurisdiction.
In the event of non-payment, NOREXCO® reserves the right to repossess the goods held by the buyer, without prejudice to any action for damages. This retention-of-title clause is enforceable against any third party, including in the event of receivership or judicial liquidation.
Prices and products
NOREXCO® may change its product range and prices without notice. Prices are expressed in euros excluding VAT.
Payment terms
Payment of orders
New customers or account opening: payment in advance before delivery. A 2% (excl. VAT) discount is granted for payment by bank transfer, cash or cheque within 14 days, excluding charges, subject to no previous payment defaults.
Maximum legal terms (French LME law, 2008): 45 days end of month or 60 days net from the invoice date. For overseas territories: term running from customs clearance if transport is organised by NOREXCO®, or 21 days after the goods are made available in mainland France.
Late-payment penalties
ECB refinancing rate plus 10 points, with a minimum of 3 times the legal rate in force. Payable without reminder. Any payment incident makes all sums due immediately payable.
NOREXCO® reserves the right to cancel an order or require advance payment in the event of unfavourable information about the customer's solvency. In the event of non-payment after an unsuccessful formal notice, NOREXCO® may pass the file to a debt-collection agency or initiate legal proceedings, all costs of which shall be borne by the debtor.
Force majeure
NOREXCO® cannot be held liable in the event of impediment due to circumstances beyond its control: strike, natural disaster, logistics crisis, major supply disruption, etc.
No liability for product use
NOREXCO® declines all liability for damage, direct or indirect, resulting from non-compliant use, incorrect installation, or an application unsuited to the technical characteristics of the product.
It is the buyer's responsibility to check the regulatory compliance of the products in the country of use.
By confirming an order, the Customer acknowledges having read these terms and conditions of sale and accepts them without reservation.
